Terms and Conditions for Wings Grp Trading (Pty) Ltd
Applicable to the following online stores operated by Wings Grp Trading (Pty) Ltd:
1. Scope of Applicability
These General Terms and Conditions ("Terms") apply to all purchases made through the online stores operated by Wings Grp Trading (Pty) Ltd, including KitchenAid Africa (KitchenAidAfrica.com), Sage Africa (WingsGroupHome.co.za) and Bialetti Africa (BialettiAfrica.com) (collectively referred to as the "Website").
These Terms govern the relationship between Wings Grp Trading (Pty) Ltd ("Wings Group", "we", "us" or "our") and the purchaser ("you", "your" or "the customer").
Any deviation from these Terms must be expressly agreed to in writing by Wings Group. By placing an order through the Website, you agree to be bound by these Terms.
2. Conclusion of Contract
All orders must be placed online via the applicable Website. Product listings are invitations to treat and do not constitute a binding offer.
You may amend your order prior to checkout. By clicking the "Complete Order" button, you submit a legally binding offer to purchase. Upon receipt, you will receive an order confirmation email acknowledging receipt of your order. However, a binding contract is only concluded once we dispatch your order and send a shipping confirmation.
Wings Group reserves the right, where permitted by applicable law, to decline or cancel any order, including where fraud, misuse, pricing errors, stock discrepancies or other legitimate operational reasons are identified.
Until dispatch, all orders remain subject to stock availability and verification. In the event of a stock discrepancy, inventory error or any other unforeseen issue affecting availability, we reserve the right to cancel all or part of an order. Where appropriate, we may offer a suitable alternative product. If you do not wish to accept the alternative, or if no suitable alternative is available, we will issue a full refund for the affected item(s).
3. Right of Return (Cooling-Off Period)
Where applicable under the Electronic Communications and Transactions Act (ECTA), customers purchasing online may cancel the transaction within seven (7) business days after the date of receipt of the goods, provided that:

Refunds will be processed within 10 business days after the returned goods have been received and inspected. Refunds will be made using the original method of payment.
4. Prices and Shipping Costs
All prices displayed include Value Added Tax (VAT) where applicable.
Standard delivery charges and any free shipping thresholds are displayed on the applicable Website and may vary from time to time.
No additional fees are charged for accepted payment methods.
Pricing Errors
We make every reasonable effort to ensure that prices displayed on the Website are accurate. However, if a product is displayed with an inadvertent and obvious pricing error due to a typographical, technical, administrative or system error, Wings Group reserves the right to cancel the order prior to dispatch.
Where payment has already been received, we will notify you of the error and issue a full refund to the original payment method as soon as reasonably possible.
Nothing in this clause limits any rights afforded to consumers under applicable South African law.
5. Delivery
We currently deliver within South Africa only.
Estimated delivery times are displayed on the applicable Website. Delivery estimates are provided in good faith and are not guaranteed.
If, after your order has been placed, a product becomes unavailable due to stock discrepancies, supplier shortages or delays, inventory errors or any other unforeseen circumstance, we will notify you as soon as reasonably possible. Where appropriate, we may offer you a suitable alternative product or colour. If you do not wish to accept the alternative, or if no suitable alternative is available, we will issue a full refund for the affected item(s) using the original payment method.
If delivery cannot be completed because incorrect delivery details were supplied or no one is available to receive the goods, additional delivery charges may apply.
5.1 Force Majeure
Wings Group shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, strikes, civil unrest, pandemics, supplier failures, transport disruptions, power failures, natural disasters or government action.
6. Payment Terms
Payment is required in full at the time of checkout.

No goods will be dispatched until payment has been successfully received and verified.
7. Offsetting and Retention
You may not offset any amounts owed to you against payments due to Wings Group unless such right is legally enforceable or acknowledged by us in writing.
8. Retention of Ownership
Goods remain the property of Wings Group until full payment has been received. Until ownership passes, the goods may not be resold, pledged or otherwise disposed of.
9. Warranty and Liability
All products are sold with the warranties required under South African law.
If a product is found to be defective within six (6) months of delivery, you are entitled to:repaired, replaced or refunded (subject to product inspection and nature of defect) in accordance with section 56 of the Consumer Protection Act.
This warranty does not apply where the defect results from misuse, abuse, negligence, improper installation, unauthorised repairs or modifications, fair wear and tear or failure to follow the manufacturer's instructions.

Wings Group shall not be liable for indirect or consequential losses, loss of profits or damages not directly caused by our negligence or breach of duty. Our liability is limited to the purchase price of the product unless otherwise required by law.
Nothing in these Terms excludes, restricts or limits any rights or remedies that cannot lawfully be excluded or limited under the Consumer Protection Act or any other applicable legislation.
10. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa, including the:
